Following another minor ban by Twitch after he streamed the Olympics, a DMCA claim was also made. After consulting with his lawyer, xQc shared that he has filed a countersuit against the DMCA claim, claiming that watching the Olympics during his stream falls under fair use and that he will fight it, much to the chagrin of some of his fellow Twitch users.

One of the first to speak out was Ethan Klein of H3H3, who has fought a fair use lawsuit in the past and emerged victorious. This set a precedent in the YouTube scene. According to H3H3, xQc is being screwed over by his lawyer and the lawsuit is doomed to fail. He also admits that he is nervous about a possible lawsuit and the consequences it could have for the whole scene.

While Pokimane responded to H3H3’s statement, she also spoke out with criticism herself. She said that there could be some kind of conflict of interest, referring to xQc’s lawyer, Ryan Morrison (The Video Game Attorney), who acts as both lawyer and agent. Morrison himself said he expected the IOC to “let the matter rest” and that he did not expect any legal action, but that he would defend xQc “no matter what the further course of action. “
